1. Acceptance of Terms
These Terms of Use (the "Terms") govern your access to and use of the TaleTerra app, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian. A higher age restriction applies where required by a store rating or local law.
3. Service and License
TaleTerra uses generative AI to create interactive fictional stories. The current version does not require a user account, stories are primarily stored on your device, and AI generation requires an internet connection.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Service for personal, non-commercial purposes on devices you own or control. Except where expressly permitted by law, you may not copy, sell, rent, distribute, reverse engineer, interfere with, or exploit any part of the Service.
4. Your Content and Generated Content
You retain the rights you have in content you submit. You represent that you have the right to submit that content and are responsible for its legality. To provide the Service you request, you grant us a limited, worldwide, royalty-free license to transmit, process, temporarily store, transform, review, and protect your input and related story context, including the right to provide necessary sublicenses to providers identified in the Privacy Policy. This license applies only as needed to provide and protect the Service.
To the extent permitted by applicable law, you may use output generated for you for personal, lawful purposes. AI output may not qualify for copyright protection and may be similar to output generated for others. We do not promise that you have exclusive rights, copyright, or other intellectual-property rights in any output.
5. AI Output and Content Notice
AI output is generated automatically and may be inaccurate, incomplete, upsetting, biased, or inconsistent with your expectations. Output is for fictional entertainment only and is not medical, legal, financial, mental-health, or other professional advice. Do not rely on output for high-risk real-world decisions.
Your content preferences and our safety controls may reduce unwanted content but cannot guarantee that it will never appear. If you encounter inappropriate or dangerous content, stop the related generation and use the in-app reporting feature to report the output to TaleTerra without leaving the App.
6. Prohibited Conduct
You may not use the Service to create, request, upload, distribute, or facilitate:
- child sexual abuse material, any sexual content involving minors, grooming, or sexual exploitation;
- non-consensual intimate content, sexual violence, human trafficking, or sexualized abuse of real people;
- credible threats, support for terrorism or violent extremism, or actionable instructions for violence;
- content that encourages suicide, self-harm, eating disorders, or other serious harm;
- hate, harassment, bullying, stalking, or degrading treatment based on a protected characteristic;
- fraud, malware, intrusion, theft, circumvention of safeguards, or other unlawful conduct;
- infringement of intellectual property, privacy, publicity, or other rights;
- impersonation, unauthorized disclosure of personal information, or deceptive content about a real person;
- interference with the Service, bypassing filters or limits, automated scraping, API abuse, or unauthorized access for others; or
- other conduct prohibited by law or likely to create serious risk to users, TaleTerra, or others.
7. Content Safety, Reporting, and Enforcement
We may use reasonable measures such as automated filters, safety models, user reports, and human review to refuse generation, restrict content, investigate abuse, or limit access to the Service. We have no obligation to generate any particular content.
You may use the in-app reporting feature to report inappropriate or dangerous AI output to TaleTerra without leaving the App, or contact support at support@taleterra.ai. Submit only the minimum information needed to address the issue. We may retain necessary records and use reports to improve content filtering and safety controls. We may also report matters to relevant authorities when required by law or when a serious safety risk exists.
8. TaleTerra Rights
The Service and its software, interface, branding, designs, preset content, and related materials are owned by TaleTerra or its licensors and are protected by applicable intellectual-property laws. Except for the limited license expressly granted in these Terms, no other rights are granted to you.
9. Third-Party Services
The Service relies on backend hosting, third-party AI, Apple, Google, and device-operating-system functions. Third-party services may be subject to their own terms and privacy policies. Our Privacy Policy explains related data processing. An interruption, change, or discontinuation of a third-party service may affect availability.
10. Changes and Termination
We may update, modify, suspend, or discontinue all or part of the Service to maintain security, comply with law, or improve the Service. You may stop using and uninstall the App at any time.
We may limit or terminate access if you materially or repeatedly violate these Terms, infringe others' rights, threaten Service security, or if the law requires us to act. Content rights, disclaimers, liability limits, and other provisions that by their nature should survive will remain effective after termination.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TALETERRA DOES NOT WARRANT THAT THE SERVICE WILL ALWAYS BE SECURE, UNINTERRUPTED, OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE, APPROPRIATE, ORIGINAL, NON-INFRINGING, OR SUITABLE FOR YOUR EXPECTATIONS. Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALETERRA AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM USE OF OR INABILITY TO USE THE SERVICE. TALETERRA'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50 IF YOU PAID NOTHING.
This Section does not limit liability that cannot legally be limited or affect nonwaivable consumer rights.
13. Apple and Google Terms
If you downloaded the App from the Apple App Store, these Terms are between you and TaleTerra, not Apple. Apple is not responsible for the App, its content, maintenance, or support. You may use the App only on Apple-branded products you own or control as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of this Section and may enforce it.
If you downloaded the App from Google Play, these Terms are between you and TaleTerra, not Google. Google is not responsible for the App, its content, maintenance, or support. You must also comply with applicable Google Play terms.
14. Applicable Law and Disputes
These Terms and disputes related to your use of the Service are governed by the law applied by a court with jurisdiction, without affecting nonwaivable consumer-protection rights where you live. The parties will first attempt in good faith to resolve a dispute through support@taleterra.ai. These Terms do not require arbitration or waive class-action or jury-trial rights.
15. Changes and General Terms
We may update these Terms and will post the revised version and effective date at https://taleterra.ai/terms/. If a change is material, we will provide additional notice where required by law or platform rules.
If part of these Terms is unenforceable, the remaining parts remain effective. A delay in enforcing a right is not a waiver. You may not assign these Terms without our written consent; we may assign them as permitted by law in a restructuring, merger, acquisition, or asset transfer. These Terms and the Privacy Policy are the entire agreement between you and TaleTerra regarding the Service.
